Our agency can only offer car rental services as a MAIN DRIVER OR HOLDER of a car rental reservation to: INTERNATIONAL TOURISTS, in that sense we are NOT responsible if the rental can not be made because the holder does not meet these conditions and will be considered NO show, applying 100% penalty. In case a client wishes a relative, friend, etc. resident in Cuba to drive the rental car, *we can only include him/her in the reservation as ADDITIONAL DRIVER with the corresponding extra charge.
IMPORTANT INFORMATION:
- Only rentals of 7 days minimum and up to 45 days maximum can be executed.
- THE AGENCY will charge the CLIENT: the rental (Prices given in USD / Day) and other additional services (Insurance and / or return and / or additional driver) at the request of THE AGENCY; and this value will be reflected in the Pre-Invoice / Invoice, specifying the customer the services that are included. The services that are not included in the reservation such as: insurance, return, additional driver, fuel, extra days of rental, penalties for breakage or missing in the car at the time of termination of the service by the customer's responsibility, etc, will be paid by the customer to THE AGENCY by credit card directly at the rental office in Cuba.
- The additional driver may be a Cuban resident in Cuba, but he/she must be present at the rental office with the regular driver for the corresponding procedure.
- If THE AGENCY'S client receives during the delivery of the rented car, a vehicle of lower category and/or a vehicle of the same category but of a lower price than the one requested and confirmed, THE AGENCY will invoice or correct the pre-invoice for the car received (as appropriate). A written communication via email and attached copy of the signed Lease Agreement is required to process the claim to the supplier.
- If at the beginning of the rental service the vehicle was delivered more than five (5) hours late or was not given to THE AGENCY's client, in case of claim, THE AGENCY may evaluate the possibility of returning the value corresponding to one (1) day of rental, always with prior presentation of the documents that cover it, under communication and agreement between the parties.
- The terms and conditions related to the Insurance, are provided in the Car Rental Agreement, which is signed between the user (named driver) and the authorized representatives of The Carrier, extending the liability coverage to the additional driver declared in the Contract, provided that the driver is recognized as not responsible, which will be accredited with the official document issued by the Specialized Protection Services Company (SEPSA) or with the corresponding police report, otherwise a deductible of up to 350.00 USD will be applied for the damages. The insurance coverage includes risks against fire, lightning and transportation, total and partial theft and robbery, collision and overturn, comprehensive coverage, natural catastrophes, civil liability (in damages to other people's property up to 7459.00 USD and in bodily injury or death up to 2084.00 USD at a rate of 417.00 USD per person). 417.00 USD per person).
- In the case of payments made at the Rental Office by means of Bank Cards and proceeding at the end of the service any refund, the customer of THE AGENCY will claim the amount through the Bank that represents him abroad and if applicable the money is returned to the customer's account. If a discount is applicable because the customer has caused damage to a car, this evidence will be presented to the Bank.
- Extensions of rental reservations will not be accepted during the periods from July 1st to August 31st and from October 1st to April 30th.
- Drivers under 18 years of age are not allowed, and it is required to have at least one year of experience.
- The driver will be confirmed according to Category (from 1 to 6), applications for specific models will not be accepted.
GENERAL CONDITIONS
- The customer will pay 1 extra day of rent, if the requested delivery time is more than 2 hours after the time of collection of the vehicle at the beginning of the service.
- The client must comply with the conditions and terms established in the Rental Contract that is given to him/her to sign at the Rental Point. This includes the use of the Auxilio en la Vía contacts in case of any emergency as defined in said contract.
- The schedule of pick up and delivery of the vehicles must correspond to the working hours of the rental point requested.
- The client must pay the car rental company VIA: the additional charges at the opening or closing of the contract (fuel, additional driver, penalty, traffic fines, etc.) all in USD or Convertible Currency and by card. Cash payments will not be accepted.
- The car will be delivered with fuel and the client must return it with the same amount or pay its value according to the official prices in force. The customer is responsible for the use of the correct type and quality of fuel for the vehicle (special gasoline only or diesel).
- During the service and if necessary, the customer has the obligation to present the car for maintenance services when applicable, according to the established mileage or for the inspections that the service provider has arranged for automotive and road safety, in the facilities that are indicated.
- If the client liquidates the vehicle before the date of the initial request, it must be claimed in writing to THE AGENCY, in order to be able to invoice the amount of the actual days enjoyed.
- In the event that the vehicle received by the client causes technical loss due to an accident in which he/she is declared responsible by the National Revolutionary Police (PNR), the car will not be changed and the client will lose the right to the refund of the amount corresponding to the remaining rental days and the amounts for insurance.
DRIVER:
- The customer must present at the time of making the rental contract: your passport, residence abroad and driver's license, otherwise the service will not be executed and will be considered a No Show.
- Drivers under 18 years old are not allowed, and it is required to have at least one year of experience.
- Vehicles of category 6 (Family) can only be rented by drivers who are 21 years of age or older and who have had their driver's license for at least 2 years.
- When the driving of the rented vehicle by persons not authorized in the contract is detected, the official authorities will notify this situation in the contract to the client with a penalty amounting to the loss of the amount of the days pending to be used, as well as will proceed to withdraw the rented vehicle from the client.
ADDITIONAL DRIVER:

There is the possibility of additional drivers (different from the one who signs the contract) with a driving license with at least one year of experience. In this case an extra charge of 30.00 USD per driver applies (two per contract maximum). Additional drivers are only authorized to drive the vehicle, but they will not be able to pick up or deliver the car, receive refunds, or request extensions. These transactions with VIA must be made by the owner Customer.

You are entitled to two additional drivers, payable at the time they decide to be included in the Contract. Foreign: from 18 years of age onwards. **Cuban resident in Cuba or abroad: from 21 years of age onwards.
INSURANCE COVERAGE
- The Insurance covers against fire, lightning and transportation, total and partial theft and robbery, collision and overturning, comprehensive coverage, natural disasters and civil liability, extending civil liability coverage to the additional driver declared in the Contract. (as long as the driver is recognized as Not Responsible).
- In case of accident, the client must submit a police report to VIA and will only pay for the damage caused if said report establishes a violation of the clauses set forth in the lease contract (drug and alcohol consumption, driver not registered in the contract).
- The insurance coverage does not cover loss or damage to accessories (brushes, before, rear-view mirrors, etc). These charges will be paid directly by the client.
- The coverages are not valid for a driver who is not registered in the contract from the beginning of the rental.
Exclusions from the Insurance Coverage:
a) The Insurance exclusions imply THE AGENCY'S client's obligation to pay the amount corresponding to the value of the damage or loss caused. b) Damage or loss intentionally caused to the vehicle by THE AGENCY'S client and ruled by the competent authority. c) Damages caused in an accident as a consequence of: being intoxicated or under the influence of drugs or similar. d) Damages or losses occurred while driving the rented vehicle by a person not authorized in the Rental Agreement, which obliges him/her to pay the amount corresponding to the value of the damage or loss, as well as the penalty established for unauthorized driver. e) Using the car in circuits, races, contests, apprenticeship practices, illicit activities, loading goods, excess passengers. f) Transporting explosive, toxic or flammable materials. g) Not having a driver's license or a category not in accordance with the vehicle being driven. h) Accidents caused by technical malfunctions, caused by the driver. i) Damage to tires, punctures or blowouts, unless it is the direct result of an accident that has also damaged other parts of the vehicle. j) Leaving the vehicle in unsafe places in case of floods, sea penetrations, cyclones.
The client will assume the total costs for the damages caused to the car in the following cases:
- Use of narcotics, alcohol or medicines that prevent the client or additional drivers duly registered in the rental contract from performing their duties.
- If the report of the police or SEPSA, establishes a violation in any of the clauses of the rental contract signed by the customer and VÍA.
- If the car is driven by any person not registered in the rental contract.
- If the client does not submit a police report or a report from SEPSA.
In case of accident or theft, the customer must:
- Immediately notify the competent authority nearest to the place of the event (police) or contact, without any additional charge, the services of the Security and Protection Company (SEPSA), available in Havana City, Santiago de Cuba, Holguín, Villa Clara and Varadero.
- To notify the car rental company VÍA CAR.
- To take the necessary safety measures with the vehicle, avoiding additional damages.
- Fill out the damage report provided by an official of VIA.
PAYMENT METHOD:
To rent the car, as a partial or total payment method, the customer may present a card: VISA, MASTERCARD and AMERICAN EXPRESS even if they are issued by North American banks. The contract holder must agree with the card holder used to make the payment.
CANCELLATIONS AND NO-SHOW POLICY:
- For cancellations with less than 72 hours notice, No Show will be charged.
- It will be considered a No Show if the client does not show up to pick up the car within 4 hours after the requested time at all rental points with the exception of the airport where the car will be kept for up to 24 hours.
- When a No Show is considered: it is penalized with one day of rental.
CLAIMS
Claims submitted by customers from their country of origin to THE AGENCY will be attended, as long as the customer communicates it within a term not longer than one year from the date of the incident or the fact that caused the claim, attaching a copy of the written disagreement, complaint or claim of the customer before the installation providing the service and a copy of the contract of lease of the vehicle.
CONDITIONS OF DELIVERY OF THE CARS (DROP OFF)

The client may deliver the rented car at the established hours and at any of the Rental Offices in the country. A return fee will be paid according to the return rates shown below, provided that the return is made at an office outside the province where the vehicle was rented. In the case of Havana, a return fee will be charged provided that it is settled outside the point where the rental started.
